Terms and Conditions - Azkar App

These terms and conditions ("Agreement") set forth the general terms and conditions of your use of "Azkar App" mobile application ("Mobile Application" or "Service" or "App") and any of its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you" or "your") and Azkar Mobile Application developer ("Developer", "We", "Us" or "our"). By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and the Developer, even though it is electronic and is not physically signed by you, and it governs your use of the Mobile Application and Services.

Disclaimer of Warranty and Limitation of Liability

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE CONTENT, INCLUDING BUT NOT LIMITED TO ITS ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY.

THE SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE HEREBY DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF TITLE, MERCHANTABILITY, NON INFRINGEMENT OF THIRD PARTIES' RIGHTS.

NEITHER WE NOR OUR PARTNERS SHALL BE SUBJECT TO LIABILITY FOR TRUTH, ACCURACY, OR COMPLETENESS OF ANY INFORMATION CONVEYED TO USERS OF THE SERVICES OR FOR ERRORS, MISTAKES OR OMISSIONS THEREIN OR FOR ANY DELAYS OR INTERRUPTIONS OF THE DATA OR INFORMATION STREAM FROM WHATEVER CAUSE. YOU AGREE THAT YOU USE THE SERVICES AND THE CONTENT AT YOUR OWN RISK.

IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE SERVICES AND THE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF A WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Azkar App NO-ADS Supplementary Terms and Conditions

The Services will remove ads from all features and services. The Azkar App NO-ADS service that are available only under these Supplementary Terms and Conditions and subject to your payment of the fees referenced below.

Access to Azkar App NO-ADS Service

Currently, the Azkar App NO-ADS service is accessible only via our mobile application Azkar on Android devices. The NO-ADS service is available to allow you to access all feature and services without any ads, the subscription to these services is totally optional, you may continue to use the free services/content if you don’t wish to subscribe and not to support the App.

Azkar App NO-ADS Service Cancellation

You may cancel your subscription anytime through your Google Play subscription settings page. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR ACCOUNT AND WE ARE NOT RESPONSIBLE FOR YOUR FAILURE TO PROPERLY CANCEL THE NO-ADS SERVICE NOR FOR ANY CHARGES AND FEES YOU INCUR AS A RESULT OF NOT PROPERLY CANCELING THE NO-ADS SERVICE. In the event of any failure of the App to conform to any applicable warranty, You may notify Google, and Google will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Google will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Your sole responsibility.

Fees for the Azkar App NO-ADS monthly service

If you subscribe to the Azkar NO-ADS service monthly subscription plan, you will be subject to monthly subscription fees in accordance with the Fee Schedule and related information (the "Fee Schedule"). Subscriptions are automatically renewed unless cancelled during the subscription period.

Fees for the Azkar App NO-ADS annual service

If you subscribe to the Azkar App NO-ADS service yearly subscription plan, you will be subject to annual subscription fees in accordance with the Fee Schedule and related information (the "Fee Schedule"). Subscriptions are automatically renewed unless cancelled during the subscription period. You are responsible for reviewing the Fee Schedule from time to time and remaining aware of the fees charged by us and any applicable discounts. The Fee Schedule, including subscriber or any discounts, is subject to change at any time in our sole discretion.

Payment

Payment for the Azkar App NO-ADS service must be made via your Google Play account.

Force Majeure

We shall not be liable for any delay or failure to perform or discontinuity of service provision resulting from causes outside its reasonable control, including, but not limited to, The developer is unable to provide The Service or Update the App for any reason, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

Changes and amendments

We reserve the right to modify this Agreement or its terms relating to the Application and Services at any time, effective upon posting of an updated version of this Agreement in the Application. You may check any updates in App setting page or our website. Continued use of the Mobile Application and Services after any such changes shall constitute your consent to such changes.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Mobile Application and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, don't use the App, you are not authorized to access or use the Mobile Application and Services.
